INFORMATION FOR WHISTLEBLOWERS REGARDING POSSIBLE ILLEGAL CONDUCT ACCORDING TO ACT NO. 171/2023 COLL., ON THE PROTECTION OF WHISTLEBLOWERS, AS AMENDED

In accordance with Act No. 171/2023 Coll., on the protection of whistleblowers, as amended (hereinafter referred to as the “Act”), the company allows notifications not only via the Ethical Hotline but also through the company’s internal whistleblowing system.

 

The company accepts notifications in accordance with the Act that contain information about possible illegal conduct that has occurred or may occur within the company, where the whistleblower, even indirectly (e.g., through an employment agency), performed or is performing work under an employment contract, voluntary work, or internship (or sought to do so), or had contact with a person related to the work in an employment relationship, voluntary work, or internship, and which:

 

a) has the characteristics of a criminal offense,

b) has the characteristics of an offense for which the law provides a fine of at least 100,000 CZK,

c) violates the Act, or

d) violates another legal regulation or European Union regulation in the areas listed in the Act.

 

Notifications can be made in writing or orally. The responsible persons for receiving notifications under the Act are: corporate lawyer Mgr. Jan Felcman, HR manager Olga Piskačová, or the company’s financial director Ing. Lada Hájková.

Postal address for submitting written notifications: Corporate lawyer, Mlékárna Hlinsko, a.s., Kouty 53, 539 01 Hlinsko. THE ENVELOPE MUST BE MARKED “DO NOT OPEN – NOTIFICATION”. Failure to meet this condition may prevent full confidentiality of the whistleblower’s identity or the confidentiality of the communicated information.

 

The company excludes receiving notifications from individuals who do not perform work or other similar activities for the company according to §2, paragraph 3, letters a), b), h), or i) of the Act.

 

The company accepts only NON-ANONYMOUS notifications that contain the whistleblower’s identity details (name, surname, and date of birth, or other details that allow the identification of the whistleblower). We request that the whistleblower provide contact information to allow for quicker and more efficient processing of the notification. If the whistleblower does not leave a contact, they will not be informed of the resolution of their notification.

 

Knowingly false notifications are considered an offense under the Act, for which a fine of up to 50,000 CZK can be imposed. Such a whistleblower is also not entitled to protection against retaliatory measures under the Act.

 

Anyone can at any time submit their report regarding illegal conduct or violations of the Ethical Code via the Ethical Hotline of the group or to the company’s Compliance officer. The Ethical Hotline addresses all reports (including those that are not listed in the Act’s areas) from all whistleblowers (including third parties and other whistleblowers not covered by the Whistleblower Protection Act) even anonymous reports. The resolution of these reports is governed by the Compliance Program rules, not by the Act.

The whistleblower has the right to submit notifications that meet the requirements under the law to the external whistleblowing system of the Ministry of Justice at www.oznamovatel.justice.cz.
